What is Eligibility for Gratuity?

An employee should meet this eligibility criteria to apply for gratuity from the UAE government.

An employee must have completed at least 1 year of continuous service.
After completing 1 year, employees can receive gratuity for a fraction of a year on a proportional basis.
An employee must have done continuous work, and unpaid leave days are excluded from the service period.
Eligible users can receive gratuity after 1 year, whether they resign or are terminated.
The person must not have committed any legally defined gross misconduct.

How is Gratuity Calculated?

For gratuity, your last drawn basic salary is calculated. Benefits like housing, transport, and other allowances are not included.
For the first 5 years, you get 21 days’ basic salary for each year.
After 5 years, you get 30 days’ basic salary for each extra year.
If you have completed less than a year, extra months are calculated proportionally after completing 1 year.
Your gratuity cannot be more than 2 years of basic salary.
Your employer should pay your final dues within 14 days after your contract ends.
